However, in its observation, the Division Bench headed by justice AR Dave made it clear that State Subject Law will be respected and only permanent state subjects will be allowed to take admission to the medical colleges of Jammu and Kashmir.
“The decision will come on Friday but one thing court has assured us that Article 370 will not be trampled and State Laws will be respected,” State’s Commissioner Secretary Law Muhammad Ashraf Mir told IBNS on phone from New Delhi.
He further added that even if the latest ruling of the apex court is implemented in Jammu and Kashmir, those who are not permanent residents of the state will not get admission in local colleges of the state.
“The court observed that whether medical entrance examinations are conducted either by BOPEE or CBSE in Jammu and Kashmir, only permanent residents will be allowed to take admission in the state colleges,” Mir said.
He further said that the court made it clear that there will be no impact of Supreme Court ruling on the reservation rule. “Let me make it clear, whatever judgment the court passess today (Friday), one thing is clear that non-state subjects will not be permitted to get admission in the state's colleges,” Mir claimed.
The Jammu and Kashmir government on Monday had filed an application in the Supreme Court seeking exemption of the state’s aspirants from National Eligibility Entrance Test (NEET) for medical courses.
