Maharashtra court sets free man convicted under Arms Act

Thane, May 25 (UNI) A Maharashtra court has granted liberty to a 43-year old man who was convicted under the Arms Act of 1959 and also imposed Rs 10,000 fine on him, as the court deemed him as 'a law abiding person'.

In the judgement passed on May 22, First Class Judicial Magistrate P D Chavan stated,"If the accused is sentenced to imprisonment,it is going to affect his family.His family will suffer unnecessarily for their no fault."

The order further read, "It will frustrate the whole object of the law.The accused was present on each and every date during the trial,it shows that he is a law abiding person.Considering all the aspects,I am inclined to show leniency to the accused while imposing sentence."

The convicted man Ahemdali Shitabali Shaikh,a native of Devria district in Uttar Pradesh,was nabbed on November 8 of 2011 as he came to sell firearms in Navghar town of Bhayandar suburb,told the Additional Public Prosecutor(APP) Jaishree Korde.

The police seized a country-made pistol and 3 live cartiges from Ahemdali's possession and subsequently arrested him under the Arms Act of 1959,added the APP.
