Gyanvapi case: Muslim side submits old orders, claims land belongs to Waqf

As hearing on the plea seeking permission for daily worship at Shringar Gauri Stahl and other deities resumed in the court of District Magistrate Ajay Krishna Vishvesha, the counsels of the Muslim side led by lead counsel Shamim Ahmad reiterated their claim that the Gyanvapi mosque complex is the property of the Waqf.

Ahmad submitted that as the property is of Waqf Board the plea could not be heard in the civil court, instead, the matter should be raised before the Waqf Board Court.

While making submissions Shamim Ahmad documents, including an order issued in the Din Mohammad case in 1936 and an order passed by the Allahabad high court in 1942.

Madan Mohan Yadav, the counsel of the Hindu side, said that Shamim Ahmad submitted before the court that Anjuman Intezamia Masajid Committee made a pact with the Uttar Pradesh government to provide its land for setting up a police booth in Kashi Viswanath-Gyanvapi mosque complex in the year 1992.

The counsels of the Committee once again reiterated that the case is barred by Rule 7 Order 11 of Civil Procedure (CPC), Places of Worship Act (Special Provisions) 1991 and even the Kashi Vishwanath Temple Act 1983 does not apply, Yadav said.

After hearing both sides, District Judge Ajay Krishna Vishvesha fixed Wednesday as the next date for the hearing. The hearing will begin at 11 Am and it will also be heard after lunch at 2 pm when the Muslim side will submit their rejoinder.

Senior advocates Hari Shankar Jain and Vishnu Shankar Jain were also present in the court. After the hearing was over Vishnu Shankar Jain said that Waqf board documents were fraud and they will expose it.
