Delhi gangrape case: Supreme Court dismisses plea of a convict who claimed he was a minor in 2012

New Delhi/IBNS: A Supreme Court on Tuesday dismissed a plea filed by Nirbhaya case convict Pawan Kumar Gupta where he had pleaded to be treated as a minor.

The SC move now made it clear that Gupta will not be treated as a minor.

Pawan Gupta had moved the Supreme Court challenging high court's dismissal of his claim of juvenility at the time of offence on Dec 2012.  

The Bar Council has issued notice to advocate AP Singh who is appearing for the Nirbhaya rape and murder case convict Pawan Kumar Gupta after Delhi High Court directed it to take action against him for producing fake documents in the court and not appearing for the hearing.

On Dec 19 last, the High Court had reprimanded Singh for producing forged documents in the court to prove his client Pawan Kumar Gupta was a minor at the time of committing the crime. The Court not only dismissed Gupta's petition but also imposed Rs 25,000 as costs on advocate AP Singh.

The Bar Council said Justice Suresh Kumar Kait in his Dec 19 order had referred the matter to Bar Council directing it to take action against advocate AP Singh.

The council has read the order and decided to issue the notice for Feb 28 and asked him to reply within 14 days of the notice, Bar Council added.

The court said Singh had either deliberately or without applying his mind filed the false affidavit to delay the legal process in the Nirbhaya case, and asked the council to show cause him.

A Delhi court on Friday issued fresh death warrants for the Nirbhaya gangrape convicts, Mukesh, Vinay Sharma, Akshay Kumar Singh and Pawan Gupta, who are now likely to be executed at 7 am on Feb 1.  

Meanwhile, President Ram Nath Kovind on Thursday rejected the mercy plea of Mukesh. 

On Dec 16, 2012, Nirbhaya, who was a 23-year female physiotherapy intern, was gang-raped, assaulted and tortured at a private bus in Delhi when she was travelling with her friend.

She was raped by six people including the driver of the bus.

The victim had succumbed to her injuries 13 days after the horrific crime was committed.

The incident had sparked national and international outrage. Both the state and central government were brought under the scanner for not providing adequate protection to women in the national capital.
