Bihar crisis: Patna HC upholds Nitish's election as JDU Legislative Party leader
Patna, Feb 12 (IBNS): In a fillip to Nitish Kumar, the Patna High court on Thursday ordered that he can continue as the leader of the Janata Dal (United) Legislative Party or JD(U), reports said.
This came after legislators, who are loyal to Kumar, filed a petition in the court challenging the stay on his election as the new leader of the legislature party.
On Wednesday, the High Court stayed his election as JDU Legislative Party leader after some leaders close to Chief Minister Jitan Ram Manjhi, who has been expelled by the party, took legal steps to stop the former Chief Minister of Bihar from staking claim to form government in the state.
Meanwhile, Kumar, who returned to Patna on Thursday with his supporting MLAs, has alleged that Bihar Governor KN Tripathi's decision to ask Manjhi to prove his majority in the state assembly on Feb 20 is intended to "allow horse-trading of MLAs."
Kumar had earlier asked for an immediate floor test so that he could return to power in Bihar soon.
For the same reason, he had also paraded 128 legislators to the Rashtrapati Bhawan and conveyed his strength to President Pranab Mukherjee. on Wednesday evening.
However, the Bihar Governor on Wednesday night rejected Kumar's demand for a special sitting of the assembly for the trust vote and has asked Manjhi to seek confidence of the house on the first day of the Budget session.
After being expelled from the Janata Dal (United), Bihar Chief Minister Jitan Ram Manjhi on Monday met state Governor KN Tripathi and said he is ready to prove his majority through secret ballot.
Kumar on Monday also met Governor Keshri Nath Tripathi and staked his claim to form the government in the state which is witnessing a political crisis for the past few days.
The JD (U) on Monday expelled its Bihar Chief Minister Jiten Ram Manjhi amid an ongoing turmoil after former CM and party leader Nitish Kumar staked claim to form the government in the state when 97 MLAs unanimously elected him as the the leader of the state Assembly at a legislative party meeting.
JD-U said Manjhi is being backed by the BJP president Amit Shah and also has support of Modi and had been involved in anti-party activities.
Manjhi has been asked to show his strength on the floor of the House by the Governor. Manjhi earlier refused to step down as the CM revolting against his party.
The JD-U had alleged that the BJP and PM Narendra Modi is unethically helping Manjhi.
Nitish Kumar was elected the leader of the Bihar Assembly at a legislative party meeting on Saturday while his bete noire, chief minister Jitan Ram Manjhi recommended to the governor to dissolve the house, stoking possibility of an early election in the state.
Manjhi was named as Bihar CM on May 17, 2014 after Nitish resigned following the party's electoral drubbing in the last Lok Sabha polls.
