Allahabad HC sentences ex-MLA Mukhtar Ansari to 7 years imprisonment in threat case

Lucknow/UNI: Setting aside acquittal by the lower court, the Lucknow bench of Allahabad High Court on Wednesday held mafia-turned-politician Mukhtar Ansari guilty of issuing life threats to a jailor and sentenced him to 7 years rigorous imprisonment along with a fine of total Rs 37,000.

The bench of Justice Dinesh Kumar Singh sentenced Mukhtar terming the accusation of issuing life threats to a jailor, who had lodged an FIR against the former MLA at Alambagh police station, to be correct.

It may be noted that in 2003 the then Jailor SK Awasthi accused Mukhtar of issuing life threats and had lodged an FIR against him.

According to the FIR lodged by the jailor, he was threatened with dire consequences when he ordered to search the people, who had come to meet Mukhtar Ansari in the jail. As per the FIR during this Mukhtar abused the Jailor and also pointed a pistol at him.

A Special MP-MLA court has acquitted Mukhtar in this case due to lack of evidence, after which the state government filed a revision appeal in the High Court.

In his order Justice Singh has said, "In view of the foregoing discussion, present appeal is allowed. Impugned order dated December 23, 2020 passed by Special Judge, MP/MLA, Additional Sessions Judge, Court Lucknow is set aside."

The court ordered, "The accused-respondent is convicted for offences under Sections 353, 504, 506 of the IPC. He is sentenced for offence under Section 353 IPC (assault or criminal force to deter public servant from discharge of his duty) to undergo rigorous imprisonment for 2 years with fine of Rs 10,000.

"For offence under Section 504 IPC (intentional insult with intent to provoke breach of the peace), he is sentenced to undergo rigorous imprisonment for 2 years with fine of Rs 2,000."

"For offence under Section 506 IPC (criminal intimidation), the accused is sentenced to undergo rigorous imprisonment for 7 years with fine of Rs 25,000. All the sentences would run concurrently," it said,
